The Chief Justice of the Supreme Court considered cyberspace a corrupt space and said: "Today, the bullets of moral corruption have also found their way into our children's rooms."
According to Ashura News, quoted by Mehr News Agency, Hojjatoleslam Mohammad Jafar Montazeri, on Tuesday evening at the national conference "Right and Justice" held at the Faculty of Administrative Sciences and Economics of Ferdowsi University of Mashhad, stated: "One of the serious and worrying problems of the country is the increase in the number of family lawsuits."
The Chief Justice of the Supreme Court added: "The number of family lawsuits in the Supreme Court is much higher than the total number of other legal and criminal lawsuits."
Without referring to the statistics, he said: "The reason for this situation is the opening of a hellish door that the West has opened for us, and that is nothing but cyberspace."
Montazeri criticized the disregard for warnings and stated: "We have been shouting for years that cyberspace must be managed, and the Supreme Leader of the Revolution has also emphasized this many times. But when this door is open, all kinds of moral corruption enter society and people's beliefs are questioned, which we see as a result in the current situation."
The Chief Justice of the Supreme Court considered cyberspace an environment contaminated with corruption and added: Today, bullets of moral corruption have even found their way into our children's rooms. This is despite the fact that years ago, the Supreme Leader of the Revolution had warned against corruption and cultural invasion, but there was no one to listen.
Acknowledging the existence of problems in the judicial system, he said: I accept the weaknesses and shortcomings of the judiciary, but the country is an interconnected system, and the realization of justice is the duty of all elements of society; because society is made up of all of us.
Montazeri continued: If I were to list the shortcomings of the judiciary, there are many; from budget problems and shortage of human resources to cultural and structural issues.
The Chief Justice of the Supreme Court considered the judge to be the most important element of the judiciary that should be trained in universities and said: Law schools should consider themselves obligated to train judges at the level of the Islamic Republic system.
He added: The judiciary recruits judges in two ways; One through an exam and the other from among elite students. If universities introduce these elites, we will attract them. The regulations for selecting elite judges were also recently signed and announced by the head of the judiciary.
Montazeri said: We are also seeking to resolve the shortcomings and problems in the Supreme Court, but we must know that resolving some problems takes time.
Each branch of the Supreme Court has 240 new cases per month
The head of the Supreme Court added: One of the main problems in the court is the high volume of incoming cases; so that in May of this year, despite 50 active branches, we witnessed the arrival of 12,000 cases. This means that each branch receives 240 new cases per month.
He added: One of the solutions to reduce this pressure was to amend two legal articles, which caused the incoming cases to decrease by 40 percent.
Montazeri stated: During my term of office, four specialized working groups in the legal, criminal, narcotics, and family fields have been activated, which have been very efficient.
Stating that some of the problems of the judiciary are rooted within the judiciary itself and some are related to external factors, the Chief Justice added: It was approved at the time to establish a peace court and add 10,000 employees to the judiciary, but unfortunately, not a single new force was added in this capacity.
He noted: The two main missions of the court are to supervise the proper implementation of the law in the courts and to create uniformity in the issuance of court rulings. Unfortunately, in recent years, the court's supervisory performance over the implementation of the law in the courts has not been satisfactory, and I do not approve of some inappropriate actions and illegal decisions. However, appropriate suggestions must be received to resolve these problems.
Montazeri said: We must increase the supervision of court decisions by at least 50 percent by utilizing new tools and existing facilities.
The Chief Justice of the Supreme Court added: "Since the beginning of the revolution, in the issue of unity of procedure, the procedure has been that if two different decisions are issued in the courts on a single issue, we review them. Last year, 14 decisions of unity of procedure were issued in the country, while we need unity of procedure among the courts to be much broader and more coherent."
Referring to the phenomenon of usury, he said: After polytheism, usury is the greatest sin in Islam and no committed person should defend it.
Montazeri emphasized: Some of the cases that are raised as usury in banks are not actually examples of usury; if banks act in accordance with the law and Sharia guidelines, usury does not occur.
The Chief Justice of the Supreme Court noted: Although there are numerous examples of usury, there must be a precise distinction and demarcation between usury and Sharia profits.
